Partnership for Tolerance and Anti-discrimination Protection in Serbia

Partners for Democratic Change Serbia and Alternative Dispute Resolution Centre (CARS), in cooperation with the Commissioner for Protection of Equality (CPE) and with support of the Delegation of European Union in Serbia, implement the project „Partnership for Tolerance and Anti-Discrimination Protection in Serbia“ (PTAPS). The Project objective is to improve the anti-discrimination protection in Serbia and to contribute to build social cohesion through raising public awareness on discrimination problems and the exhisting anti-discrimination protection mechanisms, raising capacities of the civil society organisations (CSOs), legal aid providers and other representatives of marginalised groups to adequately react in discrimination cases, as well as to create preconditions for applying the mediation techniques in discrimination cases.

Over the past few years, there have been a number of developments to the institutional and legal framework governing anti-discrimination in Serbia. The Law on the Prohibition of Discrimination (the Official Gazette, No. 22/2009) established the autonomous and independent institution – the Commissioner for Protection of Equality (the Commissioner) – authorized to deal with discrimination cases, but also provided for several mechanisms of protection of citizens who were victims of discrimination. However, despite the new legislation and establishment of the new institution – the Commissioner – numerous researches and practical examples confirm that discrimination is widely spread in Serbia, while the existing mechanisms of protection are not adequately applied.

Intending to support an open dialogue on discrimination in Serbia and improvement of cooperation in the prevention of discrimination, the Project consists of a series of panel discussions, workshops, trainings and conferences. In order to inform the public, encourage reactions to discrimination, reduce the social perspective of helplessness, but also to contribute to respect for diversity, the project considers undertaking a series of other activities such as production of leaflets, posters, promotional video, film and other promotional materials, as well as creation of manual for dealing with cases of discrimination. Specific aspect of the Project is development of system for applying the mediation in discrimination cases, which will include a series of seminars aimed to inform the public about the possibilities and specifics of the application of mediation in discrimination cases, advanced training on skills necessary for representation in mediation, as well as the specialized training for mediators that would act in cases of discrimination. Since the Law Against Discrimination authorises the Commissioner to recommend the mediation in discrimination cases, an important Project activity is also the creation of a mediation cases management model which will be adapted to the Commissioner’s existing capacities and authorities.
