ANALYSIS OF THE WORK OF THE ADMINISTRATIVE INSPECTORATE AND MISDEMEANOR COURTS IN THE FIELD OF THE LAW ON FREE ACCESS TO INFORMATION OF PUBLIC IMPORTANCE

Partners Serbia conducted two researches on mechanisms for the protection of right to free access to information of public importance.

In the first research, we analyzed the work of the Administrative Inspectorate, while the other research refers to the work of misdemeanor courts in situations in which the Administrative Inspectorate initiates proceedings as a result of violation of the Law on Free Access to Information of Public Importance.

The research was conducted at a time when the attained degree of the right of the public to has been undermined, both as a result of new legislative solutions, as well as the problems in the implementation of the existing legal framework. Therefore, their findings and the ensuing recommendations should be observed in the context of a need for removing structural shortcomings in the access to information of public importance, and the public should be enabled to defend its right to know whenever it is denied.
